Terms Of Service

The following is the ToS for the srchub service NOT the source code.

Terms of Service ("Terms")

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the https://srchub.org website (the "Service") operated by administrators of srchub ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Content

By creating an account you may upload content to the service. Any content uploaded is property or copyrighted of the person who uploaded it. We do not claim any rights, support, or guarantees over the content that users upload.

The content that users upload may be licensed under a software license and should be considered carefully. At this time we do not provide "default" or assumed license for content that is uploaded without a license.

Reasons for termination

Actions which may include but not limited to:

  • Unsolicited email sending of project updates
  • Using large amounts of system resources (or more simply using a large percentage over the average use)
  • Attempting to hack or by pass security [1]
  • Uploading copyrighted material
  • Uploading hate speech, slander, or other derogatory messages against a person or group of people
  • Uploading illegal content such as copyrighted material
  • DMCA complaints
  • Malware

[1] Please do not attempt to hack the production service, if you would like a playground to test exploits I would be happy to configure a testbed for you and if you do discover an exploit would pay you for it

Accounts and projects will not be taken down due to:

  • Factual complaints against a person or group [2]
  • Tutorials describing potential illegal activities within reasonable context [3]

[2] As long as the complaints are not derogatory or use offensive language

[3] A tutorial talking about how to use bit torrent is ok. A tutorial on how to download copyrighted material using bit torrent is not acceptable.

Appeal

If the termination was not due to:

  • DMCA complaint
  • Uploading copyrighted material

You may appeal the termination by providing evidence that the repository or project provided benefit to others.

Such evidence may include but not limited to:

Evidence of strong disagreement against the termination which may include:

  • Forum threads
  • Facebook threads
  • Mailing list threads

DMCA

Please send all DMCA takedown requests to adamsna[at]datanethost.net

DMCA takedown requests MUST be in the following format or they will be ignored/discarded:

Subject of the message must be: "DMCA Complaint"

The body must include:

  • Offending srchub username
  • Offending srchub repository
  • Links to infringed material
  • Contact information

If the format is followed - the content will be removed in a timely manner.

Any and all DMCA complaints will be posted publicly with personal contact information removed. By sending a DMCA complaint you acknowledge and accept this.

Changes To the Terms Of Service

srchub may update the Terms of Service from time to time. We will notify you of any changes by posting the new Privacy Policy on the Site. You are advised to review these Terms of Service periodically for any changes.

If you disagree with parts of anything outlined in the terms of service then you may request a change by creating an issue on the srchub issue tracker https://srchub.org/p/srchub-git/issues/ .
